The lawsuit filed against Activision by two ex-Infinity Ward leads alleges that the publisher of its Modern Warfare games carried out an “Orwellian,” “pre-ordained” investigation designed to “manufacture a basis to fire” them in order to avoid paying them bonuses. That suit, filed in the Los Angeles Superior Court on March 3, was filed by founders Jason West and Vince Zampella in an attempt to be paid royalties earned from the release of Call of Duty: Modern Warfare 2 and to regain rights to the Modern Warfare line of games.

Activision’s Call of Duty: Modern Warfare 2 javelin-bombed every other videogame in the month of November, selling an astonishing 6 million copies, the NPD Group reported Thursday. The shooter sold 4.2 million units on Xbox 360 and 1.87 million on PlayStation 3 in the U.S. last month.

Some who bought CD keys for Modern Warfare 2 – no physicial media in other words – from import resellers have seen their access to the game vanish, as Activision has apparently asked Valve to ban such keys. A poster in Valve’s official forums complained that a key he bought through G2Play.net no longer lets him open and play the game. A Valve representative, BurtonJ, called such sales “illegitimate” and confirmed the ban.
